A federal judge in California has thrown out the lawsuit filed by Elon Musk's social media company, X, against several prominent advertisers. The lawsuit had targeted major brands including Mars, Incorporated, and the LEGO Group, alleging they conspired to unlawfully withdraw advertising from the platform.
In a decisive ruling, U.S. District Judge Charles Breyer dismissed the case on two key grounds. First, the court found it lacked personal jurisdiction over the defendants. Second, and more critically, the judge ruled that X's complaint failed to adequately state a legal claim upon which relief could be granted. The lawsuit stemmed from a high-profile advertiser exodus from the platform, formerly known as Twitter, which began in late 2023 following concerns over content moderation policies.
The court's decision represents a significant legal setback for X's attempt to recoup advertising revenue through litigation. In his order, Judge Breyer granted the motion to dismiss without leave to amend, effectively closing the door on this particular legal avenue for the company. The ruling underscores the challenges platforms face in legally compelling advertisers to spend on their services, leaving X to navigate its revenue challenges outside the courtroom.
