Business owners in the smoke shop industry are expressing deep concern as a new Texas law prepares to outlaw smokable hemp products. The legislation, set to be enforced by the end of the month, will prohibit the manufacture, distribution, and sale of these items, which have become a significant revenue stream for many retailers.
The ban specifically targets pre-rolled hemp cigarettes, loose hemp flower intended for smoking, and any other hemp product designed to be inhaled. This move by the state legislature has sent a wave of anxiety through the retail sector, with numerous shop owners predicting severe financial consequences. Many stores report that these products constitute a substantial portion of their overall sales, and the sudden prohibition threatens their operational viability.
Industry representatives argue that the law creates an unfair market disparity, as smokable forms of cannabis-derived delta-8 and delta-9 THC products, which are chemically synthesized from hemp, will remain legal. This inconsistency, they claim, will confuse consumers and push the smokable hemp market underground. Shop owners are now faced with the difficult task of clearing their existing inventory before the deadline or risk facing penalties, forcing them to consider pivoting their business models in an increasingly uncertain regulatory landscape.
